Terms of Service

These Terms of Service (“Terms”) govern the website-redesign and managed-hosting services provided by AT Solutions, Inc. d/b/a Enterhost (“Enterhost,” “we,” “us”). By signing up for or using our services, you (“you,” the “Customer”) agree to these Terms.

1. The services

Enterhost provides (a) website redesigns delivered and hosted on a subscription basis, and (b) managed hosting scoped and quoted individually. These Terms cover the subscription redesign offer. Managed-hosting engagements may be governed by an additional written quote or agreement.

2. The redesign offer and pricing

The redesign subscription is offered at $49 per month or $490 per year (which includes two months free), billed in advance. There is no upfront design fee for a qualifying website provided through the redesign subscription. You may review a private preview of the proposed redesign before deciding whether to subscribe.

The offer is intended for straightforward informational business websites. Enterhost reviews each request and may decline projects that fall outside the offer, including online stores, shopping carts, customer portals, custom applications, and unusually complex sites.

3. Billing, renewal, and cancellation

Subscriptions are billed in advance through our third-party payment processor. Monthly plans renew automatically each month, and annual plans renew automatically each year, until canceled. Cancellation prevents the next renewal charge but does not create a refund for the current billing period; an annual subscription remains available through the end of the paid annual term. Annual payments are nonrefundable.

Taxes may be added to charges where applicable. Enterhost may update pricing for a future renewal after giving advance notice. You are responsible for keeping your contact and billing information current.

4. What’s included; revisions and updates

Your subscription includes the website, managed hosting, automatic HTTPS, monitoring, security maintenance, regular backups, restoration from an available backup when needed, connection to your existing domain, and technical SEO foundations. We work with you on revisions and content updates before launch, and we keep your existing content current after launch (for example, hours, staff, services, photos, and wording).

Major new functionality, substantial expansion, additional pages, or work beyond the included design refresh may require a separate written quote. We will discuss any such work with you before performing it.

5. Three-year design refresh

A customer whose redesign subscription remains active and current may request one included design refresh after each 36 months of continuous active service. Eligibility requires continuous active service; if the subscription is canceled, the eligibility period resets and begins again from the start of any new subscription. The refresh applies to the existing website and its existing scope. It is not automatic: Enterhost will prepare the refresh for the customer to review before replacing the current design. New functionality, substantial expansion, or additional pages may require a separate quote.

6. Website availability, ownership, and content

The Enterhost-built website is provided to you as part of an active subscription; you receive the right to use it while your subscription is active. You retain ownership of your domain name, the original content and materials you supply, and your existing email service. With your permission, we may manage DNS on your behalf; we do not take ownership of your domain. You are responsible for keeping your own copies of the content and materials you supply; Enterhost is not obligated to package, retrieve, export, or return those materials after cancellation.

The design, code, layout, and functioning website created by Enterhost remain Enterhost’s property and do not transfer to you upon cancellation unless purchased under a separate agreement (Section 7).

The customer grants Enterhost permission to use, reproduce, format, adapt, and display the materials the customer provides as needed to design, host, maintain, and support the website.

7. Purchasing the website

A customer may request to purchase the Enterhost-created website. Any purchase is subject to a separate written agreement and the price quoted by Enterhost at that time. No ownership of the Enterhost-created design, code, or build transfers unless the purchase price has been paid and the parties have completed the separate agreement.

8. Your responsibilities

You are responsible for the accuracy of the information you provide and for confirming that you own or have the rights to use the content, images, and materials you supply for your website. You agree to use the services only for lawful purposes and not for infringing, deceptive, or abusive activity.

9. Managed hosting

Managed hosting is scoped and quoted individually based on your requirements. Specific service levels, resources, and pricing for a managed-hosting engagement are set out in the applicable quote or agreement.

10. Third-party services

We use third-party providers to deliver the services, including Stripe or another payment processor for billing and providers for infrastructure and email delivery. Your use of the services may be subject to those providers’ terms where applicable.

11. Service changes, suspension, and termination

Enterhost may make reasonable changes to the services needed for security, compatibility, or operation. If payment remains past due, Enterhost may suspend access to the Enterhost-created website or hosting service until the account is brought current. We may also suspend or terminate the services for violation of these Terms or for unlawful or abusive use. You may cancel as described in Section 3.

12. Disclaimers

The services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not make an uptime guarantee. We work diligently to keep sites online, secure, and backed up, but we do not warrant that the services will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent permitted by law, Enterhost is not liable for indirect, incidental, special, exemplary, or consequential damages, and Enterhost’s total liability arising out of or relating to the services is limited to the amounts you paid to Enterhost during the twelve months before the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold Enterhost harmless from claims, damages, and reasonable expenses arising out of (a) materials you supply, (b) your lack of rights in materials you supply, or (c) your unlawful or abusive use of the services.

15. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any legal action arising out of or relating to these Terms or the services will be brought in the state or federal courts located in Tarrant County, Texas, and each party consents to the jurisdiction and venue of those courts.

16. General

Provisions concerning ownership, payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination where applicable. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with any applicable written quote or agreement, constitute the agreement governing the services.
